Agreement to Terms

Welcome to Sello Journeys. These Terms of Service ("Terms") govern your access to and use of the Sello Journeys mobile application (the "App"), operated by Sello Journeys ("we," "our," or "us"). By downloading, accessing, or using the App, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the App. We reserve the right to modify these Terms at any time, and your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

Eligibility

You must be at least 13 years of age to use the App. If you are under 18 years of age, you must have permission from a parent or legal guardian to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

The App is only available to users located in the United States. By using the App, you confirm that you are accessing it from within the United States.

Account Registration and Security

To use the App, you must create an account by providing your first name, last name, email address, and password. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information to keep it accurate and current
• Maintain the security and confidentiality of your password
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

You may not share your account credentials with others or allow others to access your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account.

Use of the App

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial use. This license does not include any right to resell or commercially exploit the App or its content.

Acceptable Use

You agree not to:

• Use the App for any illegal purpose or in violation of any local, state, national, or international law
• Violate or encourage others to violate the rights of third parties, including intellectual property rights
• Attempt to gain unauthorized access to the App, other user accounts, or computer systems or networks
• Use any automated means (including bots, scripts, or scrapers) to access the App
• Interfere with or disrupt the App or servers or networks connected to the App
• Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the App
• Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices
• Use the App in any manner that could damage, disable, overburden, or impair our servers or networks
• Harass, abuse, threaten, or intimidate other users
• Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity

Location Services

The App uses location services to determine when you are at specific locations and to award digital stamps. You must grant the App permission to access your device's location services to use this feature. You can modify location permissions at any time through your device settings, but doing so may limit the functionality of the App.

Digital Stamps and Content

Sello Journeys allows you to collect digital stamps by visiting curated locations. These stamps are commemorative only and have no monetary value. We reserve the right to:

• Add, remove, or modify available locations and stamps at any time
• Adjust geofence boundaries for stamp collection
• Discontinue expeditions or collections without notice

Digital stamps remain our property and are licensed to you for personal use only. You do not acquire any ownership rights to the stamps or other content in the App.

Service Availability and Technical Requirements

The App requires an internet connection to function properly. Stamp collection and other features depend on:

• Active internet connectivity
• Adequate cellular or Wi-Fi signal strength
• Enabled location services on your device

We do not guarantee that stamps will always be available for collection at all locations. Some locations may have limited or no internet access, which may prevent stamp collection. We are not responsible for your inability to collect stamps due to technical limitations, network connectivity issues, or location-related factors.

The App may periodically be unavailable due to scheduled maintenance, updates, or technical issues. We will make reasonable efforts to notify users in advance of scheduled maintenance, but we are not liable for any interruptions to service.

Intellectual Property Rights

The App and all content, features, and functionality, including but not limited to text, graphics, logos, icons, images, digital stamps, software, and the compilation thereof, are the exclusive property of Sello Journeys and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the App or its content without our prior written permission. Any unauthorized use of the App or its content may violate copyright, trademark, and other laws.

The Sello Journeys name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Sello Journeys. You may not use such marks without our prior written permission.

Account Termination and Deletion

User-Initiated Deletion

You may delete your account at any time directly through the App. When you delete your account, all of your personal information, including your name, email, password, location history, and collected stamps will be permanently deleted from our systems in accordance with our Privacy Policy. This action is irreversible.

Termination by Sello Journeys

We reserve the right to suspend or terminate your account and access to the App at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms of Service
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Requests by law enforcement or other government agencies
• Discontinuation or material modification of the App

Upon termination, your right to use the App will immediately cease, and we may delete your account and all associated data.

Disclaimers and Limitations of Liability

Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, secure, or error-free, that defects will be corrected, or that the App or the servers that make it available are free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or reliability of any location information, stamp availability, or other content provided through the App.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SELLO JOURNEYS, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

Safety and Travel Disclaimer

The App is designed to help you discover and commemorate visits to locations. However, you are solely responsible for your safety and well-being while traveling and visiting locations. We are not responsible for any injuries, accidents, property damage, or other losses that may occur while you are using the App or visiting locations. Always exercise caution, follow local laws and regulations, respect private property, and be aware of your surroundings.

No In-App Purchases or Subscriptions

Sello Journeys is currently free to download and use. There are no in-app purchases, subscriptions, or fees required to access any features of the App. We reserve the right to introduce paid features, subscriptions, or in-app purchases in the future, and these Terms will be updated accordingly.

Indemnification

You agree to indemnify, defend, and hold harmless Sello Journeys, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your use of the App, or your violation of any rights of another party.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

You agree that any claim or cause of action arising out of or related to the App or these Terms must be filed within one (1) year after such claim or cause of action arose, or it shall be forever barred.

Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Last Updated" date at the top of this page
• Send you an email notification to the email address associated with your account
• Post the updated Terms in the App

Your continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App and delete your account.

Severability and Waiver

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Sello Journeys.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sello Journeys regarding your use of the App and supersede all prior agreements and understandings, whether written or oral, regarding the subject matter herein.

BY USING THE SELLO JOURNEYS APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.
